Welcome to Valhalla Cyclery.

These Terms of Service apply to your use of the Valhalla Cyclery website, online store, products, services, content, tools and related features available at valhallacyclery.com.au and any related pages or services operated by us.

In these Terms, “Valhalla Cyclery”, “we”, “us” and “our” means Valhalla Cyclery Pty Ltd, ABN 75 664 514 836.

By accessing our website, placing an order, creating an account, contacting us, booking an inspection, arranging a test ride, purchasing a product, or otherwise using our services, you agree to these Terms and any policies referred to in them, including our Privacy Policy, Shipping Policy and Returns & Refunds Policy.

If you do not agree to these Terms, you should not use our website or purchase from us.

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified by agreement.


1. About Valhalla Cyclery

Valhalla Cyclery is an Australian cycling retailer based on the Gold Coast, Queensland.

We sell new, demo, consignment and pre-owned bicycles, frames, parts, accessories and related cycling products. Our range may include brands such as BMC, CUBE, Merida and other cycling brands made available from time to time.

We may also provide related services, including customer support, product advice, bike inspections, test rides by arrangement, trade-in enquiries, bike purchasing enquiries, and referral to third-party mechanics or service providers.

2. Eligibility and use of the website

By using our website or placing an order, you confirm that:

  • you are at least 18 years old, or you are using the website with the consent of a parent or guardian;

  • the information you provide to us is accurate, complete and current;

  • you are using the website for lawful purposes;

  • you will not misuse the website, interfere with its security, attempt unauthorised access, scrape the website, introduce malware, or use the website in a way that may damage Valhalla Cyclery, Shopify, our customers, suppliers or partners.

You are responsible for maintaining the confidentiality of any account login details and for all activity that occurs under your account.


3. Products, descriptions and availability

We make reasonable efforts to ensure that product descriptions, images, specifications, pricing, availability and other information on our website are accurate and up to date.

However, product information may occasionally contain errors, omissions or outdated information. Images may also differ from the actual product due to lighting, screen settings, supplier imagery, previous ownership, component changes, model-year variation, or normal differences between individual bikes.

Where a bike is pre-owned, consignment, demo, ex-display or otherwise not brand new, we will aim to describe its condition clearly. Cosmetic wear, prior use, component substitutions, service history and other relevant details may vary from bike to bike.

Product availability is not guaranteed until your order has been accepted by us. We may update, withdraw, discontinue or change products at any time.


4. Orders

When you place an order through our website, you are making an offer to purchase the selected products at the price shown at checkout, plus any applicable delivery or handling charges.

We may accept or reject an order at our discretion, including where:

  • the product is unavailable;

  • there is an error in price, description or availability;

  • payment is declined or cannot be verified;

  • we suspect fraud, misuse, resale activity or unauthorised commercial purchasing;

  • the order cannot reasonably be fulfilled due to delivery, supplier, stock, safety or compliance issues.

An order is accepted when we confirm acceptance or dispatch the goods, whichever occurs first.

If we reject or cancel an order after payment has been taken, we will provide a refund for the cancelled item or order.

You must review your order carefully before submitting it. Once an order has been accepted, we may not be able to amend or cancel it, particularly where the product has already been packed, collected, built, prepared, shipped or otherwise processed.


5. Pricing, GST and payment

All prices are listed in Australian dollars (AUD) unless stated otherwise.

For Australian orders, prices include Goods and Services Tax (GST) where applicable.

Prices, promotions, discounts, sale offers and availability may change without notice. The price payable is the price shown at checkout at the time you place your order, subject to correction of genuine errors.

We accept the payment methods shown at checkout, which may include credit card, debit card, Shop Pay, Apple Pay, Google Pay, PayPal, direct transfer, or other payment options made available from time to time.

You confirm that you are authorised to use the payment method provided and that the payment information you submit is accurate.

We may carry out reasonable fraud prevention, identity verification or payment security checks before accepting or dispatching an order.


6. Shipping and delivery

A flat shipping fee of $200 AUD applies to shipped bicycle orders unless otherwise stated at checkout or agreed with us in writing.

Additional shipping charges may apply for remote, regional, oversized, multi-item, special handling, or non-standard delivery locations.

Delivery costs, shipping methods and estimated delivery times will be shown at checkout where available or otherwise confirmed by us.

Delivery times are estimates only. We are not liable for shipping and delivery delays caused by freight carriers, courier networks, weather events, supplier issues, regional access issues, public holidays, customs processing, incorrect delivery information, or events outside our reasonable control.

You are responsible for providing accurate delivery details. We are not responsible for delays, failed delivery, redelivery fees or lost items caused by incorrect or incomplete delivery information supplied by you.

For bulky items such as bicycles, frames and large components, special freight conditions may apply.

Where a product is delivered to the address nominated by you, risk in the product passes to you on delivery, subject always to your rights under Australian Consumer Law.

If a return is required because of an error on our part, or because the product is faulty, damaged, incorrect, or otherwise fails to meet a consumer guarantee, we will refund the original purchase price including applicable shipping charges where required by Australian Consumer Law.

For approved change-of-mind returns, original shipping charges and return shipping costs may not be refundable unless we agree otherwise or are required by law.


7. Click and collect, inspections and test rides

Where available, you may be able to collect products, inspect bikes, or arrange test rides from our Gold Coast warehouse by appointment.

You may be required to provide proof of identity, order confirmation, payment confirmation or other reasonable verification before collection or test ride.

Test rides are subject to our approval, staff availability, safety conditions, weather, product suitability and any other conditions we reasonably consider necessary.

You are responsible for using reasonable care during any inspection or test ride. We may refuse or end a test ride if we consider it unsafe or inappropriate.


8. Bike assembly and safety

Some bicycles may be supplied boxed, partially assembled or requiring final assembly and safety checks before riding.

Unless we expressly state that a bike is fully assembled and ready to ride, you should have the bicycle assembled and checked by a qualified bicycle mechanic before use.

This may include, without limitation, checking wheels, handlebars, pedals, seatpost, saddle, brakes, gears, tyres, torque settings, suspension, battery systems, drivetrain and all safety-critical components.

We are not responsible for damage, injury, loss or poor performance caused by incorrect assembly, poor maintenance, misuse, unauthorised modification, incompatible components, or failure to obtain a proper safety check.

Nothing in this section limits your rights under Australian Consumer Law.


9. Warranties and Australian Consumer Law

Valhalla Cyclery adheres to Australian Consumer Law by providing guarantees on our products and services.

Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law. You may be entitled to a repair, replacement, refund or other remedy if a product or service fails to meet a consumer guarantee.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

If you receive a damaged, faulty or incorrect product, you may be given the choice of a repair, replacement or refund where required by Australian Consumer Law.

Manufacturer warranties may also apply to some new products. Manufacturer warranties are provided by the relevant manufacturer or distributor and may have their own terms, conditions, exclusions, processes and timeframes.

Manufacturer warranties are in addition to, and do not replace, your rights under Australian Consumer Law.

Pre-owned, demo, consignment and used products may have different warranty coverage from new products, depending on the manufacturer, age, condition and prior use of the item. However, your rights under Australian Consumer Law still apply where applicable.

If you believe a product is faulty, unsafe, damaged, incorrect, not functional, not as described, or unsuitable for its intended use, contact us promptly with your order number, photos, a description of the issue and any relevant supporting information.

We may need to inspect the product or refer it to a manufacturer, distributor or qualified technician before determining the appropriate remedy.

For bicycles and components, warranty outcomes may depend on correct assembly, maintenance, use, service history, compatibility and whether the issue is caused by a manufacturing fault, wear and tear, misuse, impact damage, modification or poor maintenance.


10. Returns, refunds and exchanges

We offer a 30-day return policy for eligible change-of-mind returns.

This means you have 30 days after receiving your item to request a return.

To be eligible for a change-of-mind return, the item must be:

  • in the same condition you received it;

  • unused, unworn and undamaged;

  • with tags still attached, where applicable;

  • in its original packaging;

  • complete with all included parts, manuals, accessories and documentation;

  • accompanied by a receipt or proof of purchase.

Change-of-mind returns are offered in addition to your rights under Australian Consumer Law. They do not replace, limit or exclude those rights.

Please include:

  • your order number;

  • your name and contact details;

  • the item you wish to return;

  • the reason for the return;

  • photos of the item and packaging, where relevant.

Returns must be approved by us before being sent back.

Items sent back to us without first requesting a return may not be accepted.

If your return is accepted, we will provide instructions on how and where to send your item. Where appropriate, we may provide a return shipping label. Whether we provide or pay for return shipping will depend on the reason for the return and your rights under Australian Consumer Law.

For change-of-mind returns, you are responsible for return shipping costs unless we agree otherwise.

We strongly recommend using a trackable shipping service with signature on delivery. Valhalla Cyclery is not responsible for returned goods that are lost or damaged in transit where you arranged the return shipping.

Once we receive and inspect your return, we will notify you whether the refund has been approved.

If approved, we will arrange the refund to your original payment method. We aim to process approved refunds within two business days of receiving the returned item at our showroom. Your bank, credit card provider or payment provider may take additional time to process and post the refund.

If more than 15 business days have passed since we approved your refund, contact us at valhallacyclery@gmail.com.

If the return is required because of an error on our part, or because the product is faulty, damaged, incorrect, not as described, or otherwise fails to meet a consumer guarantee, we will refund the original purchase price including applicable shipping charges where required by Australian Consumer Law.

A 25% restocking fee applies to approved change-of-mind returns for bikes and frames.

This fee may be deducted from your refund to cover inspection, administration, handling, repackaging, merchant fees, freight coordination and resale preparation.

The restocking fee does not apply where the return is required because the product is faulty, damaged, incorrect, not as described, or otherwise fails to meet a consumer guarantee under Australian Consumer Law.

Subject to Australian Consumer Law, we may refuse a change-of-mind return where:

  • the return was requested more than 30 days after delivery;

  • the item has been used, worn, damaged or altered;

  • the item is missing original packaging, tags, parts, accessories or documentation;

  • the item has been installed, fitted, ridden or modified;

  • the item was damaged by misuse, neglect, incorrect assembly, poor maintenance or accident;

  • the item was returned without approval;

  • the return appears unreasonable, excessive, repetitive or an abuse of our returns process.

We will not refuse a remedy where you are entitled to one under Australian Consumer Law.

The fastest way to exchange an item is to request a return for the item you have and, once the return is accepted, place a separate order for the new item.

Exchanges are subject to stock availability.

For faulty, damaged, incorrect or non-compliant goods, we will handle replacement options in accordance with Australian Consumer Law.

Subject to Australian Consumer Law, some items may not be eligible for change-of-mind return, including:

  • custom-built bikes;

  • special orders;

  • customised or modified products;

  • installed, fitted or used parts;

  • clearance items marked as final sale;

  • helmets or safety items where hygiene or safety concerns apply;

  • products damaged after delivery.

This does not affect your rights if the product is faulty, unsafe, incorrectly supplied, not as described, or otherwise fails to meet a consumer guarantee.


11. Product suitability and sizing

We may provide general product advice, sizing guidance, fit suggestions, compatibility guidance, intended-use advice, or recommendations based on information you provide.

This guidance is general only and depends on the accuracy and completeness of the information you give us. Individual fit, comfort, handling preference, flexibility, riding style and intended use vary between riders.

You are responsible for assessing whether a product is suitable for your needs before purchase. Where possible, we recommend seeking professional bike fitting, mechanical advice or in-person inspection before buying high-value bicycles, frames or components.

If an item appears unsuitable for its intended use, contact us as soon as reasonably possible.

We may be able to assist with:

  • product advice;

  • fitting or sizing guidance;

  • troubleshooting;

  • repair options;

  • replacement parts;

  • referral to a qualified bicycle mechanic;

  • an alternative arrangement before a return is required.

Nothing in this section limits your rights where a product is faulty, unsafe, not as described, or otherwise fails to meet a consumer guarantee.


12. Trade-ins, bike purchasing and consignment

Where we offer trade-in, purchasing or consignment options, any quote, estimate or valuation we provide is subject to inspection, verification and final agreement.

We may refuse, revise or withdraw a trade-in, purchase or consignment offer if:

  • the bike or product is not as described;

  • the condition, ownership, service history or component specification differs from the information provided;

  • the product appears stolen, unsafe, counterfeit, modified, damaged or unsuitable for resale;

  • required documentation or identification is not provided;

  • the commercial terms no longer make sense for us.

You warrant that any bike or product you sell, trade in or consign to us is legally owned by you, free from finance, security interests, liens or third-party claims, and not stolen or unlawfully obtained.


13. Third-party services and links

Our website may contain links to third-party websites, apps, payment platforms, finance providers, social media platforms, freight providers, mechanics, manufacturers or other third-party services.

We are not responsible for the content, accuracy, security, policies, products, services or conduct of third parties.

Your use of third-party services may be subject to separate terms and privacy policies. You should review those terms before using them.

Where we refer you to a third-party mechanic, service provider or partner, that provider remains responsible for their own services unless we expressly state otherwise.


14. Shopify

Our online store is powered by Shopify.

Shopify provides the ecommerce platform that allows us to sell products and services to you. However, any sale or purchase you make through our store is between you and Valhalla Cyclery.

To the extent permitted by law, Shopify is not responsible for products purchased from us, order fulfilment, product condition, warranties, returns, refunds, customer support or any dispute between you and Valhalla Cyclery.


15. Privacy

We collect, use, store and disclose personal information in accordance with our Privacy Policy and applicable privacy laws.

Personal information may include your name, contact details, billing and delivery address, order details, payment-related information, account information, customer service correspondence, fraud prevention information and website usage information.

Because our website is powered by Shopify and may use other third-party tools, some personal information may be processed by Shopify or other service providers, including providers located outside Australia.

16. Intellectual property

All content on our website, including text, images, graphics, logos, product copy, design, layout, photography, video, icons, trade marks, service marks and other materials, is owned by or licensed to Valhalla Cyclery unless stated otherwise.

You may access and use our website for personal, non-commercial purposes only.

You must not copy, reproduce, scrape, republish, modify, distribute, sell, licence, exploit, reverse engineer or use our website content for commercial purposes without our prior written consent.

All third-party brands, logos and trade marks remain the property of their respective owners.


17. Reviews, feedback and user content

If you submit reviews, comments, images, messages, suggestions, feedback or other content to us, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, edit, publish, display, distribute and promote that content in connection with our business, website, marketing and customer service.

You confirm that any content you submit:

  • is accurate and not misleading;

  • does not infringe the rights of another person;

  • is not defamatory, offensive, unlawful, obscene, abusive, fraudulent or malicious;

  • does not contain viruses, malware or harmful code;

  • may lawfully be used by us.

We may moderate, edit, remove or refuse to publish user content at our discretion.


18. Prohibited conduct

You must not use our website or services to:

  • break any law or regulation;

  • infringe intellectual property rights;

  • submit false, misleading or fraudulent information;

  • impersonate another person or entity;

  • interfere with website security or functionality;

  • attempt unauthorised access to systems, accounts or data;

  • upload malicious code;

  • scrape, harvest or extract data without permission;

  • use bots, crawlers, automated systems or AI agents in a way that burdens, bypasses or manipulates the website;

We may suspend, restrict or terminate access to our website or services if we reasonably believe these Terms have been breached.


19. Errors and inaccuracies

We may correct errors, inaccuracies or omissions on our website at any time, including after an order has been submitted.

This may include errors relating to product descriptions, specifications, pricing, promotions, availability, shipping charges, delivery estimates, images or stock levels.

If an error affects your order, we will contact you where reasonably possible and offer an appropriate solution, which may include cancelling and refunding the affected order.


20. Limitation of liability

To the maximum extent permitted by law, Valhalla Cyclery is not liable for indirect, incidental, special, consequential or economic loss, including loss of profit, loss of revenue, loss of opportunity, loss of data or business interruption.

To the maximum extent permitted by law, our liability for any claim arising from your use of our website, products or services is limited to the amount paid by you for the relevant product or service.

Nothing in these Terms excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot be excluded, restricted or modified under Australian Consumer Law or any other applicable law.


21. Indemnity

You agree to indemnify Valhalla Cyclery, its directors, officers, employees, contractors, suppliers and service providers against loss, damage, liability, cost or expense arising from:

  • your breach of these Terms;

  • your misuse of our website or services;

  • your unlawful conduct;

  • your infringement of another person’s rights;

  • information, content or materials you provide to us.

This indemnity does not apply to the extent the loss is caused by our negligence, breach of law, fraud, wilful misconduct, or failure to comply with our obligations under Australian Consumer Law.


22. Suspension and termination

We may suspend, restrict or terminate your access to our website or services at any time if we reasonably believe you have breached these Terms or used our services unlawfully or improperly.

Termination does not affect rights or obligations that arose before termination.

Sections dealing with intellectual property, privacy, liability, indemnity, governing law and any other provisions intended to survive termination will continue to apply.


23. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be severed to the extent required, and the remaining provisions will continue in full force and effect.


24. Waiver and entire agreement

A failure by us to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with any policies referred to in them, constitute the entire agreement between you and Valhalla Cyclery regarding your use of our website and services.


25. Assignment

You may not assign, transfer or delegate your rights or obligations under these Terms without our prior written consent.

We may assign, transfer or delegate our rights and obligations under these Terms where reasonably necessary in connection with the operation, sale, transfer, restructure or management of our business.


26. Governing law

These Terms are governed by the laws of Queensland, Australia.

You and Valhalla Cyclery submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth courts of Australia.


27. Changes to these Terms

We may update these Terms from time to time by publishing the updated version on our website.

The updated Terms will apply from the date they are published or from any later date stated in the updated Terms.

Your continued use of our website or services after the updated Terms take effect means you accept the updated Terms.
